Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of www.skates.guru (the “Website”) and any purchase you make from SKATE GURU INC (“Skates.Guru,” “we,” “us,” or “our”).

Please read these Terms carefully. By browsing the Website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.

These Terms work together with two other documents, both of which are incorporated into these Terms by reference:

  • Our SKATE GURU INC Policy, which governs returns, refunds, exchanges, shipping, international orders, warranty claims, and customer service.
  • Our Privacy Policy, which explains how we handle personal information.

If these Terms and the SKATE GURU INC Policy conflict on a matter of returns, refunds, exchanges, shipping, or warranty, the SKATE GURU INC Policy controls.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract in order to place an order. Products sold on the Website are used by skaters of all ages, but the purchaser must be an adult. If you are a parent or guardian buying for a minor, you are responsible for the order and for supervising the minor’s use of the product.

You may not use the Website if you are barred from doing so under applicable law, or if we have previously suspended or restricted your access.

3. Your Account

  • You are responsible for the accuracy of the information in your account, including your shipping and billing addresses.
  • You are responsible for keeping your password confidential and for all activity that occurs under your account.
  • Notify us promptly at [email protected] if you believe your account has been accessed without your permission.
  • You may close your account at any time by contacting us. We may retain records of completed transactions as required by law and as described in our Privacy Policy.
  • We may suspend, restrict, or close an account that we reasonably believe has been used for fraud, policy abuse, or a breach of these Terms.

4. Products, Descriptions, and Availability

We work to describe our products accurately, including sizing, model, and specifications. Even so, product descriptions, photographs, colors, and sizing charts are provided for reference and may not be perfectly accurate on every device or for every unit. Manufacturer specifications, packaging, and construction can change without notice.

Skate sizing frequently differs from street-shoe sizing and varies between manufacturers. Please consult our Sizing Guides before ordering, and contact us if you are unsure.

Products marked Final Sale are sold as-is and are subject to the specific conditions set out in the SKATE GURU INC Policy.

All products are offered subject to availability. We may limit quantities, discontinue a product, or decline to fulfill an order for an item that is out of stock or mispriced.

5. Pricing and Errors

  • All prices are shown in U.S. Dollars (USD) unless stated otherwise.
  • Prices, promotions, and shipping rates may change at any time before you place an order.
  • Applicable sales tax is calculated at checkout based on your shipping destination.
  • International orders may incur duties, import taxes, brokerage fees, and customs charges, which are your responsibility and are not included in the price shown at checkout.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to correct any error and to cancel or decline any order placed at an incorrect price, even after the order has been submitted or confirmed. If we cancel an order for this reason, we will notify you and refund any amount charged in full.

6. Orders and Order Acceptance

Your submission of an order is an offer to buy. An order confirmation email acknowledges that we received your order; it does not constitute acceptance. A binding contract is formed only when we ship the order or otherwise confirm acceptance in writing.

We may refuse, limit, cancel, or place a hold on an order, including where:

  • The item is unavailable, mispriced, or incorrectly described.
  • The shipping address is incomplete, unclear, or high-risk.
  • Payment cannot be verified or is flagged for review.
  • We reasonably suspect fraud, policy abuse, chargeback abuse, or resale in breach of these Terms.
  • The order requires customer confirmation and we do not receive a response, as described in the SKATE GURU INC Policy.

7. Payment

Payments are processed by third-party payment providers. Depending on the method you choose, this may include Stripe, PayPal, and buy-now-pay-later or installment services such as Klarna, Affirm, and Afterpay. Your use of those services is governed by that provider’s own terms and privacy policy, and approval for installment plans is determined by the provider, not by us.

By submitting payment information, you represent that you are authorized to use the payment method. Your card or account may be authorized at checkout, with the charge captured when the order is reviewed, confirmed, or prepared for shipment. We do not collect or store full payment card numbers; see our Privacy Policy.

If a payment is reversed, disputed, or charged back without a valid basis, we may suspend your account and recover the amount owed together with any reasonable costs permitted by law.

8. Shipping, Returns, Refunds, and Warranty

Shipping timelines, carrier terms, delivery risk, package protection, undeliverable packages, international orders, returns, Return Merchandise Authorization (RMA) requirements, refund calculations, restocking and repackaging deductions, exchanges, and warranty claims are all governed by the SKATE GURU INC Policy, which forms part of these Terms.

The version of that policy published at the time of your purchase generally applies to your order, unless a later version is required by law or is more favorable to you.

9. Promotions, Gift Certificates, and Loyalty Rewards

  • Coupons, discount codes, and promotions may be limited in time, quantity, or eligibility, may not be combined unless stated, and may be withdrawn at any time before an order is placed.
  • Gift certificates are redeemable only at www.skates.guru, are not reloadable, and are not exchangeable for cash except where required by law.
  • Loyalty Rewards points and referral credits have no cash value, are personal to your account, and may not be sold or transferred.
  • Points or credits earned on an order that is later returned, refunded, or cancelled may be reversed.
  • We may modify, suspend, or end the Loyalty Rewards or referral program, or expire unused points, on reasonable notice.
  • If you refer someone, you must have their permission to give us their contact details, and you may not send unsolicited or bulk messages to promote your referral link.
  • We may withdraw rewards or credits obtained through fraud, self-referral, or abuse of a promotion.

10. Reviews, Comments, and Other Content You Submit

You may be able to submit reviews, blog comments, photographs, or other content. You keep ownership of what you submit. By submitting it, you grant SKATE GURU INC a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content in connection with our business, including in marketing.

You agree that content you submit:

  • Is yours to submit and does not infringe anyone else’s rights.
  • Is not unlawful, defamatory, obscene, harassing, deceptive, or misleading.
  • Does not contain another person’s personal information without their permission.
  • Is not paid or incentivized without disclosure, where a review is concerned.

We may edit, refuse, or remove submitted content at our discretion, but we are not obliged to monitor it.

11. Acceptable Use

You agree not to:

  • Use the Website for any unlawful purpose, or in breach of any export, sanctions, or import law.
  • Scrape, crawl, harvest, or systematically copy content, pricing, or images, or use automated tools to access the Website, except for search-engine crawling that respects our robots directives.
  • Interfere with the Website’s security, bypass rate limits or bot protection, or probe for vulnerabilities.
  • Submit false, fraudulent, or speculative orders, or place orders using another person’s payment method without authorization.
  • Misrepresent your identity or your affiliation with any person or organization.
  • Resell products in a way that misrepresents them as authorized, warrantied, or endorsed by us where they are not.

12. Intellectual Property

The Website and its content — including text, product descriptions, sizing guides, photographs, graphics, layout, and software — are owned by SKATE GURU INC or our licensors and are protected by intellectual property laws. You may view and print content for your own personal, non-commercial use. You may not otherwise copy, republish, distribute, or create derivative works from it without our prior written permission.

Brand names, product names, and logos of manufacturers we sell are the trademarks of their respective owners. Their appearance on the Website indicates that we stock those products; it does not imply that we are affiliated with, or endorsed by, those manufacturers beyond our role as a retailer.

13. Third-Party Websites and Services

Order fulfillment, payment, shipping, tracking, insurance, and delivery involve third-party providers, and the Website links to third-party sites. Those providers and sites operate under their own terms and privacy policies. We are not responsible for their decisions, outages, delays, denied claims, service limitations, or fees, except where required by law.

Claims relating to third-party package protection, including Route, must be submitted through that provider’s own claims process.

14. Product Use, Fitting, and Safety

Skating is a physical activity that carries an inherent risk of injury. Skates, blades, and protective equipment must be correctly sized, fitted, mounted, sharpened, maintained, and used with appropriate protective gear and supervision.

Blade mounting, alignment, sharpening, heat molding, and final fitting are specialist procedures normally carried out by a qualified skate technician or pro shop. You are responsible for arranging proper fitting and for inspecting and maintaining equipment before each use. We are not responsible for injury or damage resulting from improper fitting, assembly, modification, maintenance, or use of a product, or from use beyond the manufacturer’s intended purpose.

15. Disclaimers

The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.

Products are covered by the applicable manufacturer’s warranty, if any, as described in the SKATE GURU INC Policy.

Nothing in these Terms excludes or limits any right or remedy you have that cannot be excluded or limited under applicable law, including rights under consumer protection law. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Website or any product purchased through it.
  • Our total aggregate liability arising out of or relating to any order is limited to the amount you actually paid for the product giving rise to the claim.

These limits apply regardless of the legal theory on which a claim is based and even if we have been advised of the possibility of the loss. They do not apply to liability that cannot be limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless SKATE GURU INC and its officers, employees, and agents from claims, losses, liabilities, and reasonable legal costs arising out of your breach of these Terms, your misuse of the Website, your infringement of a third party’s rights, or content you submit.

18. Resolving a Problem

Most issues are resolved quickly by email. Before starting formal proceedings, please contact us at [email protected] with your order number and a description of the problem, and allow us 30 days to try to resolve it. We will do the same before bringing a claim against you.

19. Governing Law and Venue

These Terms and any dispute arising out of them or your purchase are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and SKATE GURU INC agree to the exclusive jurisdiction of the state and federal courts located in Ventura County, California. If you are a consumer, this does not deprive you of the protection of any mandatory law of your country of residence, or of any right you have to bring proceedings there.

20. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

21. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its effective date. The version in force when you place an order applies to that order, unless a later version is required by law or is more favorable to you. Continued use of the Website after an update means you accept the revised Terms.

22. General

  • Entire agreement. These Terms, together with the SKATE GURU INC Policy and the Privacy Policy, are the entire agreement between you and us regarding the Website and your purchase.
  • Severability. If any provision is found unenforceable, the rest remains in force and the unenforceable provision applies to the maximum extent permitted.
  • No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
  • Assignment. You may not assign your rights under these Terms without our consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including weather, carrier disruption, customs action, labor disputes, or outages.
  • Headings. Section headings are for convenience only.
